Our Code Of Conduct & Operation Standards Procedure

Introduction

Agallwal Properties upholds a high standard of service right across our company by operating, in a responsible and sustainable way, not only within our business but also including all aspects of our external relationships with our associates too, as we believe we have a responsibility to ensure that we are providing the best possible standard of service and operations across the board at all times where possible.

For the avoidance of doubt "Our Associates' means the following: Our Clients, Business Partners, Consultants, Operatives, Affiliates or Any Other Relevant Firms and Individuals alike, that have a legitimate business relationship or legitimate business connection with Agallwal Properties.

We strive to act ethically and value the principles of integrity, honesty and respect when dealing with our staff and associates alike, we aim to apply this standard consistently in all of our company’s actions and operations where possible, to ensure that the best possible standard of performance for everyone is met.

To further these high standards, we believe that it is important to share the key principles and best practice procedures that we consider crucial to sustaining effective and enduring business relationships with all of our associates alike, who supply their services to Agallwal Properties.

Any associate that we engage with are expected to adhere to our code of conduct while at the same time comply with all applicable laws and regulations of our industry, we strongly encourage our all of our associates to comply with the principles as set out in this document and any other relevant documents referenced within it.

We are grateful to our associates for their full support and understanding with regards to the expectations we require of them as set out in our code of conduct, please note that the terms of this code are in addition to any other commercial or contractual terms agreed between us.

Ethics & Integrity

To meet social responsibilities, our associates are required to conduct business in an ethical manner and act with integrity at all times.

They should aim to provide equality of opportunity and treatment regardless of race, colour, gender, religion, nationality, sexual orientation, age, or disability, they are expected to support equal pay for work of equal value.

Further more they must oppose discrimination or intimidation towards employees including all forms or threats of physical and psychological abuse.

Gifts Or Hospitality Benefits

Any gifts or hospitality benefits received or offered by staff, and associates alike, whilst been engaged with our company must be approved and recorded, in line with our code of conduct procedures.

Staff, and associates alike must exercise discretion when accepting any gifts or hospitality benefits, from whoever offers it, whilst been engaged with our company.

We would expect anyone who is engaged with Agallwal Properties and our services in anyway to respect that no-one is obliged to or should even be accepting extravagant or excessive gifts and entertainment benefits with undue frequency.

Invitations should not be offered if they could be construed as being unusual or risk creating a sense of obligation to the host or bias in their favour.

Diversity, Inclusion & Belonging

Our company is whole heartedly committed to promoting a culture of inclusion, diversity and belonging for anyone associated with Agallwal Properties, so that everyone can feel included whilst been able to fulfil their potential without prejudice or discrimination, causing them to have to overcome unnecessary obstacles.

Our associates should also take active steps to promote of inclusion, diversity and belonging in line with their best practice policies and comply with the relevant employment laws, regulations and standards within the industry.

We may also request on occasion that our associates provide additional information in relation to their policies on inclusion, diversity and belonging.

Modern Slavery

Agallwal Properties ensures that all potential modern slavery risks related to its business practices, supply chains and operations are understood and that all steps are taken with the aim of ensuring that there is no slavery or human trafficking activities within our company, or that of the companies of our associates.

Agallwal Properties Modern Slavery Statement reflects our commitment to acting in an ethical manner and with integrity in all of our business or internal company relationships and to implementing and enforcing effective systems and controls to ensure that Modern Slavery and Human Trafficking is not taking place anywhere within our supply chains.

We expect that anyone associated with Agallwal Properties, will act in accordance with the UK Modern Slavery Act 2015 if applicable, or any similar laws in the countries in which they carry out business to ensure that no employee or individual working in any supply chain is being exploited.

In addition, we would expect that all employees are working within a safe environment where all relevant laws in relation to the following areas such as employment, human rights, health and safety are all to an international standard.

Anti-Bribery

We are committed to conducting all our business activities ethically, honestly, openly and operate a zero tolerance approach to any undue activity that could be construed as an attempt or acceptance of bribery.

We provide support to all individuals engaged with Agallwal Properties in this area by maintaining appropriate policies, training and reporting procedures.

Our associates must operate with the same approach, by complying with all applicable laws and regulations and enforce robust governance and internal control systems in their supply chains taking account of the UK Bribery Act 2010 and any other applicable laws in the countries in which they operate.

Forced Or Involuntary Labour

Our associates must not participate in human trafficking; use forced, involuntary, or slave labour; or purchase materials or services from companies using forced, involuntary, or slave labour. They must be able to certify that materials included in their products comply with the slavery and human trafficking laws of the country or countries in which they do business.

Compensation & Working Hours

Our associates must comply with the appropriate regulations and labour laws governing areas such as employee compensation, benefits, wages, working hours and conditions. They should also conduct their operations in ways that limit overtime to a level that ensures a humane and productive working environment.

Child & Juvenile Labour

Agallwal Properties is opposed to the use of any form of child or juvenile labour or practices that inhibits their development, our associates must comply with all child and juvenile labour laws to ensure that they do not employ anyone under the age of 15, or where it is higher, the mandatory school leaving age.

Health & Safety & Environment

Agallwal Properties requires all of our associates to make the proper provisions for the health, safety and welfare of their people, visitors and contractors and those in the community who may be affected by their activities.

A safe and hygienic working environment should be provided and best occupational health and safety practice promoted, bearing in mind the prevailing knowledge of the industry, and of any specific hazards.

Our associates are expected to conduct their operations in a way that minimises the impact on natural resources and protects the environment, clients, and employees. They must ensure their operations comply with all laws related to air emissions, water discharges, toxic substances, and hazardous waste disposal.

Our associates must maintain sufficient knowledge of input materials and components to ensure that they were obtained from permissible sources, in compliance with laws and regulations, we may require them to validate this origin.

Risk Assessment & Management

Our associates shall have a process to identify risks within the following areas of their operations: environmental, ethical labour practices, health and safety matters.

The process shall determine the relevant significance of each risk identified, then implement the appropriate procedures and physical controls to ensure that regulatory compliance requirements are meet.

Disclosure Of Information

Any sensitive information relating to our own business operations or our associates business operations are only to be disclosed in accordance with applicable laws and existing industry practices.

Fair Business & Competition

Our associates shall uphold the required standards, laws and regulations in the following areas: fair business advertising and competition.

Whistle-Blower Protection & Anonymous Complaints

Our associates shall provide an anonymous complaint mechanism for managers and workers alike to report workplace grievances, whilst protecting whistle-blower’s confidentiality and prohibit retaliation against them or any one associated with them.

Anti-Competitive Behaviour

Our associates shall not only understand the different types of anti competitive behaviours, but shall also not behave in a manner that would be deemed as anti competitive, such as sharing confidential information with our competitors and other associates.

Data Protection

As a business Agallwal Properties endeavours to protect all data held in relation to our staff and associates alike. We require our associates to protect any sensitive and/or confidential data which we may need transfer to them in the course of our business operations with them, in order to be compliant with all applicable General Data Protection Regulations (GDPR) as enshrined in the Data Protection Act 2018.

Any potential or actual data breaches involving the exposure of Data without our consent needs to be reported immediately to eamonn@agallwalproperties.com

Our Treating Customers Fairly Procedure (TFC)

Whilst we are not regulated by the Financial Conduct Authority (FCA), Treating Customers Fairly (TCF) is a key principle of our company.

Agallwal Properties pays attention to and aims to achieve certain standards to protect our clients and associates alike, which is in line with the FCA’s Consumer Duty rules which came into force in July 2023, with the aim to fundamentally improve client protection.

Achieving fair and positive client outcomes is central to our company culture and approach. We hope that by publishing this policy our clients and associates can clearly see what is important to us as a company and how we aim to achieve high standards in client care.

This policy aims to document our approach to TCF in cases where a client is browsing our website and looking at our services, with a view to engaging with us in business.

Our Associates Responsibility

Our associates shall have a process to monitor their compliance to our code of conduct and all applicable laws and regulations.

Continuous Improvement

Our associates are expected to improve their general performance in the following areas: environmental, labour, health and safety, in order to meet the expected standards as required by this code of conduct.

We also expect them to have a process for the timely correction of deficiencies, which are to be identified by the following means: assessments, inspections, investigations and reviews, which are to be undertaken by themselves or appointed third parties.
